We take your privacy seriously, and we try to comply with all relevant, applicable, non-conflicting laws and regulations regarding your privacy. Parkviewfinancial.com is owned and operated by Parkview Financial, LLC, a limited liability company with its principal place of business at 11440 San Vicente Blvd, 2nd Floor, Los Angeles, CA 90049 (“Parkview,” “us,” “our,” “we”).  It is our policy to respect your privacy regarding any information we may collect from you via our website (the “Site”) and its associated services.

 

This privacy policy (the “Privacy Policy”) is provided to inform you of the types of information that we collect from you, why we collect information, what we use the information for, who we share the information with, and the measures that we take to protect your information. 

 

By using the Site, you agree to the terms of this Privacy Policy.

 

We may change this Privacy Policy periodically, at our discretion.  Such changes will be posted on this Site, marked by the effective date of the latest version of this Privacy Policy.  Your continued use of the Site after any changes to this Privacy Policy will be regarded as acceptance of our practices around privacy and personal information.

1. Information Obtained by Your Submission


We obtain/may obtain certain personal information through your usage of this Site.  Such personal information may include:

  • Contact information (name, email address, title, phone number) when you use the “Contact Us” form or respond to a communication from us;

  • Other personal information that you share in content submitted to us, such as (but not limited to) feedback, reviews, messages in the “Contact Us” function, social media interactions, or customer support tools.

When you use or visit the Site, on any device, we and certain third-party apps and partners may obtain certain information from you by automated means, such as:

  • cookies (text files that websites send to a visitor’s device to identify the web browser or to store information/settings);

  • web server logs

  • web beacons (i.e. internet tags, pixel tags, which link web pages to servers and their cookies and may transmit information gathered by cookies to a web server); and 

  • other technologies.


To the extent required by applicable law, we will obtain your consent before using cookies or similar tools. 

 

3. Information Obtained from and by Third Parties

We may now or in the future engage the services/technologies of other third parties in the course of our business and running the Site.  In doing so, we may receive user information from them, or they may receive our user information.

 

We disclose your personal information to certain third parties, which may include:

  • third party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, hosting and server providers, ad networks, analytics, error loggers, maintenance or problem-solving providers, marketing or advertising providers, and professional advisors;

  • our employees, contractors and/or related entities;

  • sponsors or promoters of any competition we run;

  • courts, tribunals, regulatory authorities and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings or regulatory investigations, or in order to establish, exercise, or defend our legal rights;

  • third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to you; and

  • third parties to collect and process data.

 

Specifically, also we reserve the right to use third-party web analytics services, including Google Analytics and Facebook Pixel.  Google Analytics, Facebook Pixel, and other third-party services may utilize use automated technologies to collect data (such as IP addresses) to evaluate and monitor your usage of the Site for ways and for purposes that are included in Section 5 “Collection and Use of Information” below.

 

4. Legal Bases for Collection and Processing of Information

We collect and process information about you only where we have legal bases for doing so, and we make every attempt to comply with applicable laws and regulations in our collection, processing, and notifications regarding your information.

These legal bases depend on the services you use and how you use them, meaning we collect and use your information only where:

  • Necessary to perform a service for you (including respond to an inquiry);

  • A legitimate interest is satisfied (which is not overridden by your data protection interests), such as for research and development, to market and promote our services, and to protect our legal rights and interests;

  • We have your consent to do so for a specific purpose (for example, you might consent to us sending you our newsletter); or

  • We need to process your data to comply with a legal obligation.

 

Where you consent to our use of information about you for a specific purpose, you have the right to change your mind at any time (but this will not affect any processing that has already taken place).

 

We do not keep personal information for longer than is necessary.  While we store your information, it will be protected within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.  That said, we advise that no method of electronic transmission or storage is 100% secure and we cannot guarantee absolute data security.  If necessary, we may retain your personal information for compliance with a legal obligation or in order to protect your vital interests or the vital interests of another natural person.

5. Collection and Use of Information

We may collect, hold, use and disclose information for the following purposes, and personal information will not be further processed in a manner that is incompatible with these purposes:

  • for technical assessment, including to operate and improve our Site, associated applications, and associated social media platforms;

  • to provide you with our Site’s core features;

  • to enable you to access and use our Site, associated platforms, and associated social media channels;

  • to contact and communicate with you;

  • for internal record-keeping and administrative purposes;

  • for analytics, market research and business development, including to operate and improve our Site, associated applications, and associated social media platforms;

  • for advertising and marketing, including to send you promotional information about our services and information about third parties that we consider may be of interest to you; and

  • to comply with our legal obligations and resolve any disputes that we may have.

 

6. Cookies

This Privacy Policy covers our use of cookies.

 

A cookie is a small piece of data that an app or Site may store on your device, typically containing a unique identifier that allows the Site/app servers to recognize:

  • your device when you use the Site;

  • information about your session and/or device;

  • additional data that serves the purpose of the cookie, and any self-maintenance information about the cookie itself.

 

We reserve the right to use cookies to give your device access to core features of the Site, to track Site usage and performance on your device, to tailor your experience of our Site based on your preferences, and to serve advertising to your device.  Any communication of cookie data between your device and our servers occurs within a secure environment.

 

You may set your web browser to notify you when you receive certain cookies.  You may also restrict or disable certain cookies via your web browser.  For example, on some internet browsers, you may utilize a “do not track” feature that limits what a website can track.  These features vary depending on the browser and the website.  We currently do not respond to those signals.  As such, if you use such features to block cookies, certain features on the Site may not work, and some tracking features may continue.  We are not responsible for any changes in usage resulting from your restriction of certain cookies.

 

7. International Transfers of Personal Information

The personal information we collect is stored and processed in the United States, and we reserve the right to store and process such information wherever Parkview or our partners, affiliates, and third-party providers maintain facilities.  By providing us with your personal information, you consent to the disclosure to any overseas third parties.

 

We will ensure that any transfer of personal information from countries in the European Economic Area (“EEA”) to countries outside the EEA will be protected by appropriate safeguards, for example by using standard data protection clauses approved by the European Commission, or the use of binding corporate rules or other legally accepted means.

 

Where we transfer personal information from a non-EEA country to another country, you acknowledge that third parties in other jurisdictions may not be subject to similar data protection laws to the ones in our jurisdiction.  There are risks if any such third party engages in any act or practice that would contravene the data privacy laws in our jurisdiction and this might mean that you will not be able to seek redress under our jurisdiction’s privacy laws.

8. How Do We Protect Your Data?

Our Site is hosted on Wix.com, and your data may be stored through Wix.com’s data storage, databases, and the general Wix.com applications.  Wix.com stores your data on secure servers behind a firewall.  All data we collect and store is protected and secured. 

 

Our third-party affiliates have their own security measures in order to protect your information.

 

Please note, however, that while we have done what we can to create a secure Site, the internet is not a secure environment, and we cannot guarantee the confidentiality or security of the data that you transmit.  As such, we cannot be responsible or liable for the security of your data that you transmit through the internet.

9. Information of Children

We do not solicit or knowingly obtain, use, or store information submitted by a minor under the age of 18 without obtaining prior consent from a responsible parent or guardian.  The Site is not directed or designed to be used by minors under the age of 18 or to collect information from minors under the age of 18. 

 

10. Third Party Links

From time to time, we may include links to third party sites on the Site.  This Privacy Policy does not address the privacy or information policies of any third parties.  These third-party sites have separate privacy policies, and Parkview expressly disclaims any liability or responsibility for the content and activities of these linked sites.  You alone are responsible for reviewing that third-party sites’ privacy policies and deciding whether to commence any activities on such third-party sites.

 

11. Your Rights and Controlling Your Personal Information

 

Pursuant to the laws of certain United States state jurisdictions, and other jurisdictions we may operate in, you have rights with respect to aspects of the personal information that we obtain.  These rights include:

 

(a) Choice and consent: By providing personal information to us, you consent to us collecting, holding, using and disclosing your personal information in accordance with this Privacy Policy.  You do not have to provide personal information to us, however, if you do not, you understand that it may affect your use of our Site.

 

(b) Information from third parties: If we receive personal information about you from a third party, we will protect it as set out in this Privacy Policy.  If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

 

(c) Restrict: You may choose to restrict the collection or use of your personal information.  We reserve the right to use certain personal information for direct marketing purposes, and if you agree to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us using the details below.  If you ask us to restrict or limit how we process your personal information, we will let you know how the restriction affects your use of our Site.

 

(d) Access, deletion, and transfer: You may request details of the personal information that we hold about you.  You may request a copy of the personal information we hold about you and that we obtained over the last 12 months.  Where possible, we will provide this information in an easily readable format.  You may request that we erase the personal information we hold about you at any time.  You may also request that we transfer this personal information to another third party.  We may charge you a small administrative fee for processing of any such requests for disclosure, transfer, or deletion of your personal information.  We also maintain the right to require verification of your identity before complying with any request for disclosure, transfer, or deletion of your personal information, and we have the right to refuse your request if your identity/authorization to make such request cannot be verified.

 

(e) Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us using the details below. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.  We have the right to require verification of your identity before complying with any request for correction of your personal information, and we have the right to refuse your request if your identity/authorization to make such request cannot be verified.

 

(f) Notification of data breaches: We will comply with non-conflicting laws applicable to us in respect of any data breach.

 

(g) Complaints: If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint.

 

(h) Unsubscribe: To unsubscribe from our e-mail database or opt-out of communications (including marketing communications), please contact us using the details below or opt-out using the opt-out facilities provided in the communication.

 

(i) Non-Discrimination: Note that if you choose to exercise these rights, we may not intentionally discriminate against you in providing our Site and our services to you.  You understand any effects on our Services or our Site that result from complying with requests to restrict the personal information that you provide or from your decision to limit any cookies that we use to make our app fully functional does not constitute discrimination within the meaning of the applicable regulations.

 

12. California Residents’ Rights under the California Consumer Privacy Act (the “CCPA”)

 

Specifically, if you are a resident of California, you have rights under the CCPA and its implementing regulations. 

 

Please note that Parkview does not knowingly or purposefully engage in the sale of California Personal Information as the term “sale” is used in everyday parlance.  The only “sale” of California Personal Information that falls under the CCPA terms “sale” or “sold” which may happen on our Site may be via exchanging the California Personal Information with third-party vendors through cookies and/or online advertising.

 

As we try to protect all our users’ privacy to the maximum extent possible, California residents’ rights are otherwise stated in Section 11 above, but for the purposes of clarity, these are the types of California Personal Information that we may collect from you now or over the past 12 months:

(a) Identifiers: name, address, unique identifiers (via cookies, beacons, etc. as described herein), telephone number, email address, IP address, online identifiers;

(b) Other information, to the extent transmitted to us through the Site: signature, physical characteristics/description, internet use information, geolocation information, professional/employment-related/education information;

(c) Commercial information and internet/other network usage and activity; and

(d) Inferences drawn from the above categories.

 

We may collect the above categories of California Personal Information in the ways described in Sections 1, 2, and 3 above.

 

We may use the above categories of California Personal Information for purposes described in Section 5 above.

 

California residents have specific rights pursuant to the CCPA.  These rights are already listed in Section 11 above, but for the purposes of clarity, the CCPA-specific rights of California residents are:

(a) Notice: you can request that we disclose to you the California Personal Information that we have collected about you, the sources, and whether any have been sold or disclosed for business purposes under the CCPA over the last 12 months;

(b) Opt-Out: you can request that we do not “sell” your California Personal Information to third parties, by emailing support@parkviewfinancial.com.

(c) Deletion: you can request that we delete any California Personal Information that has been collected from you.

(d) Non-discrimination: note that we may not discriminate against you if you elect to exercise your rights under the CCPA.

 

To exercise your rights under the CCPA, please email support@parkviewfinancial.com and include the heading “CCPA Request.”  You or an agent authorized by you can make such a request (the agent must have written evidence of your authorization).  If you or your agent make a request, we may require verification of your identity and/or authorization before complying with the request.  If we are unable to verify the authenticity of a request, we may ask you for more information or deny your request.  To the extent that you submit a request to disclose, alter, or delete your California Personal Information, we may charge you a small administrative fee to cover the costs of the request.

 

13. Nevada Privacy Notice

 

We do not knowingly or intentionally “sell” personal information of Nevada residents as defined by the Nevada Privacy Law (the Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A).  If you are a Nevada resident, you nevertheless have the right to submit a request – which we have a right to verify – to us, instructing us not to make any sale of certain “personal information” as defined by the Nevada Privacy Law.  You can make such a request through our “Contact Us” form, and we ask that you please indicate that you are a Nevada resident, and entitle the request “Nevada Opt-Out.”  To the extent that you submit a request under this section, we may charge you a small administrative fee to cover the costs of the request.

14. Site Intended for Users in the United States​

We are based in the United States, and we process and store information in the United States.  As such, the Site is intended for users in the United States and its territories and possessions, and this Privacy Policy is focused on adhering to the relevant, applicable, non-conflicting laws of United States jurisdictions.

15. Business Transfers

If we or our assets are acquired, or in the event that we go out of business or enter bankruptcy, we would include data among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur, and that any parties who acquire us may continue to use your personal information according to this Privacy Policy.
